Prior to posting a testimonial, we will obtain your consent to use your name and the content of the testimonial. European Commission’s Standard Contractual Clauses:

We have implemented measures to protect your personal information, including by using the European Commission’s Standard Contractual Clauses for transfers of personal information between our group companies and between us and our third-party providers. These clauses require all recipients to protect all personal information that they process originating from the EEA in accordance with European data protection laws and regulations.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your information for as long as necessary to fulfill the purposes outline in this privacy policy unless otherwise required by law such as tax, accounting or other legal requirements. No purpose in this policy will require us keeping your personal information for longer than the period of time in which users have an account with us. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or if this is not possible (for example, if your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

 

8. HOW DO WE KEEP YOUR INFORMATION SAFE?

We have implemented appropriate technical and organization security measures designed to protect and security of any personal information we process. However, please be reminded that it is impossible for us to guarantee of 100% security of your information on internet. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. We do not knowingly collect data from or market to children under 18 years of age. By using our Services, you represent that you are at least 18 years of age or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take responsible measures to promptly delete such data from our records. ACCOUNT INFORMATION

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigation, enforce our Terms of Use and/or comply with applicable legal requirements.

11. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. NO uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy policy.

 

12. DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Yes, if you are a resident of California, you are granted specific rights regarding access to your personal information. California Civil Code Section 1798.83, also known as the “Shine the Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purpose and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. PUT ON LOVE has not disclosed or sold any personal information to third parties for a business or commercial purposes in the preceding 12 months. PUT ON LOVE will not sell personal information in the future belonging to website visitors, users and other consumers.

i. Right to request deletion of the data - Request to delete

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation or any processing that may be required to protect against illegal activities.

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match with information you have previously provided us. Depending on the type of request you submit, we may ask you to provide certain information or we may contact you through a communication method (e.g. phone or email) that you have provided to us. We may also use other verification methods or process as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extend possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verity your identity from the information already maintained by us, we may request that you provide additional information for the purpose of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

f. Other privacy rights

(1) You may object to the processing of your personal data;

(2) You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data;

(3) You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA; and

(4) You may request to opt-out of the sale of your personal information to any (third) parties. Upon receiving a request to opt-out, we will act upon the request as soon as feasibly possible, but no later than 15 days from the date of the request submission.

13. DO WE MAKE UPDATES TO THIS POLICY?

Yes, we will update this policy as necessary to stay compliant with relevant laws. We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.

 

14. DATA BREACH

A privacy breach occurs when there is unauthorized access to or collection, use, disclosure or disposal of personal information. You will be notified about data breaches when PUT ON LOVE + MARKET believes you are likely to be at risk of serious harm. For example, a data breach may be likely to result in serious financial harm or harm to your mental or physical well-being. In the event that PUT ON LOVE + MARKET becomes aware of a security breach which has resulted or may result in unauthorized access, use, or disclosure of personal information, PUT ON LOVE + MARKET will promptly investigate the matter and notify the applicable Supervisory Authority not later than 72 hours after having become aware of it, unless the personal data breach is unlikely to result in a risk to the rights and freedoms of natural persons.
